Welcome to Sustainable Support, a brand of BenandJacq, INC. By purchasing products or services, downloading content, or using our website, you agree to these Terms of Use.
1. Acceptance of Terms
These Terms constitute a binding contract between you and BenandJacq, INC, a South Carolina corporation. If you do not agree, do not purchase or use our products or services.
2. Description of Products & Services
- Digital Products: Ebooks, audiobooks, video courses, templates, checklists, and downloadable resources delivered instantly via Easy Digital Downloads.
- Services: Customer Experience audits, consulting sessions, strategy calls, and custom deliverables (reports, recordings, recommendations).
3. Eligibility
You must be 18 years or older and capable of forming a binding contract.
4. Pricing & Payment
- All prices are in U.S. dollars and exclude applicable taxes.
- Payment is processed securely via Stripe.
- You agree to pay all charges at the prices in effect when you place your order.
5. Digital Product License
Upon full payment, we grant you a non-exclusive, non-transferable, revocable license to use the digital product for your personal or internal business use. You may not:
- Resell, redistribute, or sublicense the content
- Claim copyright or trademark over our materials
- Remove copyright notices
- Use the content in competing products or services
6. Consulting & Audit Services
- Services are performed remotely unless otherwise agreed.
- You agree to provide accurate information and timely access to necessary systems.
- Deliverables remain our property until full payment is received.
- We reserve the right to use anonymized insights and case studies for marketing (no identifying client information without permission).
7. Scheduling & Cancellation (Services)
- Sessions must be scheduled within 90 days of purchase unless otherwise agreed.
- Cancellations with less than 48 hours’ notice forfeit the session (no refund).
- No refunds for no-shows.
8. Refunds & Returns
- Digital Products: All product sales are final. No refunds due to the instant-delivery nature.
- Services: Refunds are at our sole discretion. Deposits are non-refundable. Refunds (if granted) will be issued within 14 days minus any Stripe fees.
9. Intellectual Property
All content, deliverables, methodologies, and branding are owned by BenandJacq, INC or its licensors and protected by U.S. and international copyright and trademark laws.
10. Disclaimer of Warranties
Products and services are provided “AS IS” without warranties of any kind. We do not guarantee specific results from audits or consulting.
11. Limitation of Liability
To the fullest extent permitted by law, BenandJacq, INC shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the last 12 months.
12. Indemnification
You agree to indemnify and hold harmless BenandJacq, INC from any claims arising from your misuse of products/services or violation of these Terms.
13. Termination
We may terminate or suspend access immediately if you breach these Terms.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of South Carolina without regard to conflict of law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Charleston County, South Carolina.
15. Force Majeure
We are not liable for delays caused by events beyond our control.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BenandJacq, INC.
